Terms of Service

Effective as of April 17, 2026.

1. Purpose

These terms govern the use of the Chocom service, which generates social media content for professionals. Creating an account or using the service constitutes acceptance of these terms.

2. Access to the service

Chocom is reserved for professionals (freelancers, companies, non-profits). Account creation requires a valid email address and acceptance of these Terms and of the Privacy Policy.

3. Plans and billing

If a payment fails, you have a 3-day grace period to fix it before your account automatically drops back to Free. Your data remains intact.

4. Cancellation

You can cancel at any time from the billing page. Paid access remains active until the end of the billed period. No prorated refund is issued, except as required by applicable law (notably, the right of withdrawal does not apply to services already fully performed).

5. Generated content

You retain ownership of the content you generate, subject to the rights of the underlying AI models (Mistral, fal.ai). You are responsible for the final use and compliance with:

Chocom does not guarantee the uniqueness, accuracy or legal relevance of generated content. Review before publishing.

6. Prohibited uses

We reserve the right to suspend or terminate an account in case of violation, without notice in urgent cases.

7. Availability

The service is provided "as is". We aim for high availability but do not guarantee an absence of interruption (maintenance, sub-processor outage, force majeure). No compensation is due in case of temporary unavailability.

8. Limitation of liability

To the extent permitted by applicable law, our total liability shall not exceed the amounts effectively paid by the user during the last 12 months. No compensation for indirect damages (lost profits, reputational harm, reconstructible data loss).

9. Changes

These Terms may be amended. We will notify you by email of any material change at least 30 days before it takes effect.

10. Governing law

These Terms are governed by French law. Failing an amicable resolution, the courts having jurisdiction over Chocom's registered office shall have exclusive competence, subject to the mandatory public-policy rules applicable to consumers.
